PRIORITY FOR FUNERAL AND LAST ILLNESS EXPENSES INCREASED TO $15,000

Bill Description

Governor Bush signed HB 881 on June 20, 1997. HB 881 becomes effective on September 1, 1997.

This bill raises the priority for creditors' claims for funeral expenses and the expenses of last illness in a decedent's estate from $5,000 to $15,000. The changes were made to Sections 320 and 322 of the Probate Code.

The $15,000 limit applies to the estate of a person dying on or after September 1, 1997. The $5,000 limit applies to the estate of a person dying before that date.
