Commentary on HB 1136 -- Cleaning Up the Statutes
Regarding the 120-Day "Free" Filing Period in
Probate Proceedings

In 1997, the Legislature enacted HB 2702, which amended Section 118.055(d) of the Local Government Code to extend the "free" filing period in probate proceedings to the first to occur of (a) 120 days from the filing of the proceeding or (b) approval of the inventory.  Prior to 1997, the period was the earlier of (a) 90 days from the filing of the proceeding or (b) approval of the inventory.

Apparently, Section 118.056 of the Local Government Code contained a parallel provision which was not changed in 1997.  HB 1136, by Rep. Thompson, amends Section 118.056 so that it, too, changes the 90-day free period to 120 days.  [02/03/99]
